1- Purpose and Scope of the Clarification Text

As Op. Dr. Soner DÜZGÜNER, we take necessary measures to protect your personal data within the scope of the Law on the Protection of Personal Data No. 6698 (hereinafter referred to as the “KVKK” or the “Law”). We process your personal data as a “data controller” in accordance with the KVKK and relevant legal regulations, for the reasons and methods explained below.

The Clarification Text on the Processing of Personal Data by Op. Dr. Soner DÜZGÜNER has been prepared in accordance with Article 10 of the Personal Data Protection Law (KVKK), titled “The Obligation of the Data Controller to Inform,” with the aim of transparently informing you about the identity of the data controller, the method and legal basis of collecting your personal data, the purposes for which these data will be processed, to whom and for what purposes they may be transferred, the duration of data processing, and your rights listed under Article 11 of the KVKK.

The explanations made in this clarification text regarding “Your Personal Data” also cover your “Sensitive Personal Data,” and constitute your consent and explicit approval for the processing of such sensitive personal data.

3- Method of Collection and Legal Basis of Your Personal Data

Your personal data may be collected by automated or non-automated means through the affiliated units of the data controller, the website, social media platforms, call center, mobile applications, software used within the company for operational purposes, camera recordings, and verbally, in writing, or electronically. Your personal data may be created and updated throughout the duration of your relationship with the data controller, and may be stored in both digital and physical formats.

Your personal data is processed for the purposes specified under the heading "Your Processed Personal Data and Processing Purposes" and within the scope of Article 5, Paragraph 1 of Law No. 6698 by obtaining your explicit consent, or under the conditions specified in Paragraph 2 of the same article: when it is expressly provided for by law; when it is necessary to protect the life or physical integrity of the person who is unable to express consent due to actual impossibility or whose consent is not legally valid; when it is directly related to the establishment or performance of a contract and the processing of personal data belonging to the parties to the contract is necessary; when it is necessary for the data controller to fulfill its legal obligation; when it is necessary for the establishment, exercise, or protection of a right; or when processing is necessary for the legitimate interests of the data controller, provided that it does not violate the fundamental rights and freedoms of the data subject.

 

4- Purposes of Processing Your Collected Personal Data

The purposes of personal data processing are listed below.

  • To carry out appointment activities on our website and to verify the identity information of the person performing the transaction through our site.
  • In case an appointment is made, to inform our patients about the appointment, provide information, and send appointment reminders.
  • Planning and managing the clinic's internal operations and daily activities, as well as ensuring the supply of medication.
  • Carrying out auditing and/or regulatory duties by authorized public institutions and organizations, as well as professional organizations with public institution status.
  • Fulfilling information and document requests made by judicial authorities and/or administrative bodies.
  • To provide information and promotion regarding our products and services, to evaluate complaints and suggestions, and to contact you directly through the communication channels shared with the data controller,
  • Planning and managing the financing of all provided services, and issuing invoices,
  • Taking all necessary technical and administrative measures for systems and applications within the scope of data security,
  • Protection of public order and health
  • Provision and management of healthcare services such as medical diagnosis, treatment and care, and supply of medical materials

 

5- Your Processed Personal Data and Your Rights Under the Law on the Protection of Personal Data

Your personal data is processed securely in accordance with the Personal Data Protection Law, either due to legal obligations or in order to provide better service in the operations of the data controller.

As the personal data owner, we inform you that you have the following rights pursuant to Article 11 of the Personal Data Protection Law.

  • To learn whether your personal data is being processed
  • To request information if your personal data has been processed
  • To learn the purpose of processing your personal data and whether they are used in accordance with this purpose,
  • To know the third parties to whom your personal data is transferred domestically or abroad,
  • To request correction of your personal data if it is processed incompletely or inaccurately, and to request that the correction be notified to the third parties to whom your personal data has been transferred,
  • To request the deletion or destruction of your personal data in case the reasons requiring its processing cease to exist, despite being processed in accordance with the law and other relevant legislation, and to request notification of the actions taken to the third parties to whom your personal data has been transferred in case your data has been processed incompletely or inaccurately,
  • To object to the emergence of a result against the person by exclusively analyzing your processed data through automated systems,
  • To request compensation for damages in case your personal data is processed unlawfully and causes harm.

 

6- To whom and for what purpose your processed personal data may be transferred

Your personal data is retained by the data controller and is not transferred to third parties. In accordance with the KVKK and relevant health legislation, by ensuring all necessary technical and administrative measures to provide an appropriate level of security, your personal data may be transferred for the purposes stated above, and if deemed necessary, beyond this text with consent, to institutions or organizations as specified in Articles 8 and 9 of the KVKK within the framework of personal data processing conditions.

 

7- Data Processing Period and Retention Period

Your personal data will be processed by the data controller strictly for the purposes stated in this Clarification Text; in compliance with all relevant laws and regulations regarding data processing and statute of limitations periods. In case of any changes in data processing periods in the laws, the newly determined periods will be applied.
